Terms and Conditions
Definitions:
- Movement Amsterdam: The entity using these terms and conditions, located at Derde Schinkelstraat 1a3, 1075 TJ, Amsterdam.
- Client: The individual entering into an agreement with Movement Amsterdam.
- Agreement: The contract between Movement Amsterdam and the client.
- Training: Any personal training session, group class, or workshop provided by Movement Amsterdam.
- Trainer: The individual conducting training on behalf of Movement Amsterdam.
- Sports Studio: Movement Amsterdam's gym.
- Website: The website www.movemenamsterdam.nl is managed by Movement Amsterdam.
Article 1 | General & Applicability
- These terms and conditions apply to all agreements between you and Movement Amsterdam.
- In case any provision of these terms and conditions is invalid, the remaining provisions remain valid. Both parties will work together to replace void provisions.
- If there are any issues with interpretation, these terms and conditions will prevail.
- If a situation arises that is not addressed here, it will be resolved following these terms and conditions.
- Movement Amsterdam's leniency in enforcing these terms does not waive its right to demand strict compliance.
- Associated individuals like partners and trainers can also invoke these terms.
Article 2 | Offers
- Movement Amsterdam's offers are revocable and non-binding.
- Movement Amsterdam uses packages, memberships, and individual rates. All prices include VAT.
- Clients must provide accurate information upon which Movement Amsterdam bases its offer.
- Movement Amsterdam is not liable for errors or mistakes on its website, publications, contracts, or email communications.
- Movement Amsterdam may temporarily suspend accepting new clients.
Article 3 | Registration
- Agreements, like memberships or individual lessons, are established when clients register on Movement Amsterdam's website.
- Agreements are finalized when clients confirm the general terms and conditions on the website.
- Confirmation emails are sent after online agreements. Contact Movement Amsterdam if you don't receive one.
- clients/clients agree to the specified rate and period.
- Movement Amsterdam reserves the right to reject applications, especially for health reasons.
- By entering an agreement, clients/clients consent to Movement Amsterdam taking photos for social media.
Article 4 | Right of Withdrawal
- Clients/clients have a 14-day cancellation period starting the day after agreement.
- To cancel, email info@movementamsterdam.com within 14 days.
Article 5 | Term of Agreement
- memberships may have different periods, automatically extended by a month.
- Clients/clients may terminate at the end of the agreed membership period with one month's notice.
- Terminate via the eversports account. Pausing is allowed for injury, illness, or pregnancy.
Article 6 | Payment
- Invoices must be settled within 30 days from the invoice date.
- Failure to pay on time incurs interest at 11% per year unless statutory interest is higher.
- For late payments, clients have two weeks to settle the amount.
- Until payment, clients can't participate in classes. No refunds for memberships or class cards.
Article 7 | Prices
- Movement Amsterdam can adjust rates.
- clients/clients are notified at least 1 or 2 months before changes take effect.
Article 8 | Class Registration and Cancellation
- Personal Training: Canceling within 24 hours or no-show incurs a 100% charge.
- Group Classes: Register and cancel via website or app. Movement Amsterdam can cancel due to low registrations or force majeure.
Article 9 | Force Majeure
- Movement Amsterdam is not obliged to fulfill obligations during force majeure, like illness, internet failure, or government measures.
- If it lasts over two months, either party can terminate the agreement.
Article 10 | Liability
- Participation is at the client/client's risk.
- Movement Amsterdam is not liable for damages or injuries.
- Movement Amsterdam's advice is result-oriented but not guaranteed.
- The client/client is responsible for their health.
- Movement Amsterdam is not liable for property damage, loss, or theft.
- Exceptions apply if the damage results from Movement Amsterdam's intent or gross negligence.
